When renting a shop there are certain considerations that will help with your search for retail space:

Location: Choose a location that aligns with your target market and business needs. Consider factors like foot fall, accessibility to public transport, profile and proximity to competitors. Some businesses such as estate agents or restaurants often favour a pitch to create a destination for that use.

Budget: Determine your budget for rent, utilities, insurance, and any additional costs associated with the space. Make sure you're financially prepared for both upfront costs such as deposits and rent (which is due in advance) and ongoing expenses. It is always best to plan for contingency for un budgeted expenses. Make sure you understand your VAT rate and obligations. Some properties are registered for VAT (so VAT will be payable on top of the rent and charges) other properties may nt be registered for VAT. Rent and property prices are always quoted exclusive of VAT. Unless you are VAT registered you may not be able to claim this back!

Size and Layout: Assess your space requirements based on the type of retail business you're running. Consider factors such as the layout, floor plan, storage space, and whether the shop's size meets your operational needs. It is important to have space to grow but having underutilised space can be expensive.

Lease Terms: Carefully review the lease agreement. Pay attention to the lease duration, renewal provisions, repair clauses, and any restrictions or requirements imposed by the landlord.

Legal and Regulatory Compliance: Whist the same statutory requirements (in terms of gas certification, electrical safety checks and Asbestos Regulations etc) exist in commercial property often the duty holder is the occupier. Ensure the shop is compliant. You should also check your use fits into the consented planning use for the property. The landlord may be comfortable with your retail use and business plan but some high street uses such as a beautician may fall outside of Class E which is the planning use most shops will have.

Negotiation: Negotiate the lease terms with the retail agent acting for the landlord. This could involve discussing rent, lease duration, maintenance responsibilities, and any potential improvements or modifications to the retail space.

Utilities and Services: Clarify who is responsible for paying for utilities (water, electricity, gas, etc.) and other services (maintenance, waste disposal, etc.). Sometimes services such as bins are provided privately so you will need to arrange for the them separately.

Lease Deposit: Understand the amount of rent deposit and any situations whereby the landlord may be able to use that deposit. There is not tenant deposit scheme for commercial property. This is usually defined under a rent deposit deed. This lease deposit is usually refundable and acts as a safeguard against potential damages. Please note a rent deposit is different to any rent paid in advance.

Insurance: It is typical for a landlord to obtain building insurance cover and recharge this cost to the tenant. It is always recommended to get budget from the landlord as to what this cost is. You will need to purchase additional insurance cover for your business, stock, and public liability.

Lease Renewal and Exit Clauses: Remember leases will have a defined start and a defined end date. Most occupiers request 5 years with a tenant break year 3. It may not be possible to end your lease before the break date so ensure you have the ability to assign or underlet the shop should it become surplus to your business. If there is a break understand the process and notice required to determine the lease. Not all leases are renewable so you may need to vacate when the lease ends. You can ask for a protected lease which will give you a legal right to renew (provided you have complied with the lease terms!)
